In this policy, “Northern Peninsula Surgery”, "us", "we" or "our" means Northern Peninsula Oral & Maxillofacial Surgery Pty Ltd ABN 44 164 753 100.

 

We are firmly committed to privacy and are bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) (“the Act”).

This Privacy Policy ("Policy") explains how information about you or associated with you (“personal information”) is collected, used and disclosed by us when you visit our website ("Site").

The protection of your privacy is very important and we have adopted the following practices to safeguard the confidentiality of your personal information.

WHAT IS PERSONAL INFORMATION?

When used in this policy, the term “personal information” has the meaning given to it in the Act. In general terms, it is any information that can be used to personally identify you. This may include (but is not limited to) your name, age, gender, postcode and contact details (including phone numbers and email addresses). If the information we collect personally identifies you, or you are reasonably identifiable from it, the information will be considered personal information.

 

WHAT INFORMATION IS COLLECTED BY US?

The categories of information we collect can include:

  1. Information You Provide. When you complete the Patient Form on the Site we may collect a variety of information, including:

    • Contact Information such as your name, email address, phone and mobile number, and home address (“Contact Information”);

    • Your Medicare and Insurance Information including; Medicare Number and Private Health Insurance Policy details

    • Health Information including your medical history and conditions (“Special Categories of Personal Data”)

    • Other Information such as your gender, date of birth, details of your next of kin, occupation and details of your visiting medical practitioner and dentist
       

  2. Information Provided by Others. We may be provided with information relating to you on the Site by other users who have completed a Referral Form.
     

  3. Information from Content You Upload. When you upload data or document to the Site, we may collect information about the content of the document as well as the time, date and place the document or content was taken or uploaded (also known as metadata).
     

  4. Cookies and Similar Technologies. We may use cookies and similar technologies to collect, analyze and store information, to improve the Site, and to identify and prevent fraudulent activities.
     

If you provide personal information to us about someone else through the Referral Form on the Site, you must ensure that you are entitled to disclose that information to us and that, without us taking any further steps required by privacy laws, we may collect, use and disclose such information for the purposes described in this Privacy Policy. For example, you should take reasonable steps to ensure the individual concerned is aware of the various matters detailed in this Privacy Policy. The individual must also provide the consents set out in this Privacy Policy in respect of how we will deal with their personal information.
 

WHY DO WE COLLECT, HOLD, USE AND DISCLOSE PERSONAL INFORMATION

We use your personal information for purposes described in this Policy, which may include to:

  • Register a patient file under your name.

  • Provide you with the medical services that you request from us;

  • Communicate with you: to respond to your comments and questions and to provide customer service to you.

  • with your consent only, to contact you (including by SMS, email or post) with information about our services which either you request, or which we feel will be of interest to you (“Direct Marketing”).

  • Protect the Site and Northern Peninsula Surgery’s property: to detect and prevent abusive, fraudulent, malicious or potentially illegal activities, and to protect the rights, safety or property of Northern Peninsula Surgery.
     

Your personal information will not be shared, sold, rented or disclosed other than as described in this Privacy Policy.
 

DATA SECURITY

Northern Peninsula Surgery has physical, electronic and procedural safeguards to protect the personal information it collects from unauthorised access, modification and disclosure.  Amongst other things:

  • we safeguard our IT systems against unauthorised access by the use of Secure Socket Layer (SSL) to establish an encrypted connection between a browser or user's computer and our server or website.

 

  • Electronic personal information is stored in databases requiring logins and passwords for access and is restricted to staff who require access in order to do their work.

 

  • Any documents containing your personal information are stored in a secured cabinet within the premise.
     

If a data breach occurs, such as if personal information that we hold is subject to unauthorised loss, use or disclosure, we will respond in line with the Office of the Australian Information Commissioner's Data breach notification—A guide to handling personal information security breaches. We will aim to provide timely advice to you to ensure you are able to manage any loss (financial or otherwise) that could result from the breach.
 

SHARING PERSONAL INFORMATION WITH THIRD PARTIES

We may share your personal information with the following categories of third parties, including:

  1. our service providers and sub-contractors, including but not limited to health service providers, pathology laboratories, suppliers of technical and support services;

  2. a medical expert, an insurer, a medical defence organisation, or a lawyer, solely for the purpose of addressing liability indemnity arrangements (such as reporting an adverse incident), or for the defence of anticipated or existing legal proceedings

  3. in connection with any company transaction, such as a merger, sale of assets or shares, reorganization, financing, change of control or acquisition of all or a portion of our business by another company or third party or in the event of bankruptcy, dissolution, divestiture or any related or similar proceedings; and

  4. to, in our discretion, (i) satisfy any applicable law, regulation, subpoena/court order, legal process or other government request, (ii) investigate and defend ourselves against any third party claims or allegations, (iii) protect against harm to the rights, property or safety of Northern Peninsula Surgery, its staff and patients or the public as required or permitted by law and (v) detect, prevent or otherwise address criminal activities, security or technical issues.

Except for what is written in this privacy policy, we will not share any of your personal information to any third party without notifying you and/or getting your consent. If you do consent and later change your mind, you can remove consent and our permission to use this information. Please see below for your rights to withdraw consent.
 

YOUR CHOICES AND RIGHTS

Choices:

At any time:

  • You can choose not to provide us with personal data.  If you choose to do this, you can continue to visit the Site and browse its content, but we won’t be able to register you as a Patient.

  • You can turn off cookies in your browser settings. If you turn off cookies, you can continue to visit the Site and browse its content, but our online services might be less effective.

  • You can choose for us not to use your personal information for Direct Marketing. We will request your consent to do this, but you can choose to refuse your consent. If you have given your consent and want to retract it later, then you can opt-out by unsubscribing to our communications

 

Rights:

  • update any personal information which is out of date or incorrect;

  • restrict the way that we process your personal information;

  • provide your personal information to a third party provider of services; or

  • provide you with a copy of any personal information which we hold about you (although we reserve the right to charge a reasonable fee for this).

 

You have the right to withdraw your consent in relation to us processing your Special Categories of Personal Data (as mentioned above) at any time. You can do this by contacting us via rpoms@gmail.com.  

Please note that we will retain medical records as required by law.

 

 

UPDATING YOUR PERSONAL INFORMATION

It is important to our relationship that the personal information we hold about you is accurate and up to date. During the course of our relationship with you, we will ask you to inform us if any of your personal information (or details of your organisation) has changed.

If you wish to make any changes to your personal information that we hold about you, you should contact us to have it updated. We will generally rely on you to assist us in informing us if the information we hold about you is inaccurate or incomplete.
 

ACCESSING YOUR PERSONAL INFORMATION

We will provide you with access to the personal information we hold about you, subject to limited exceptions in the Privacy Act as outlined below. You may request access to any of the personal information we hold about you at any time.

To access personal information that we hold about you, use the contact details specified below. We may charge a fee for our reasonable costs in retrieving and supplying the information to you.

Denied access to personal information

There may be situations where we are not required to provide you with access to your personal information. For example, such a situation would be where the disclosure of such information would breach another person’s privacy, or if your request is vexatious.

An explanation will be provided to you if we deny you access to your personal information we hold.
 

HOW YOU CAN COMPLAIN ABOUT A BREACH OF PRIVACY?

If you believe your privacy has been breached by us, have any questions or concerns about our Privacy Policy please contact us using the contact information below and provide details of the incident so that we can investigate it.
 

We will treat your requests or complaints confidentially. Our representative will contact you within a reasonable time after receipt of your complaint to discuss your concerns and outline options regarding how they may be resolved.
